General terms and conditions

These General Terms and Conditions apply to all products and services offered by Migros Club Schools.
Valid as of November 2018.
 

Registration and payment of the course fee*

Payment of this amount becomes compulsory once you have registered, whether verbally or in writing, for a course. Non-payment of the course fee does not constitute cancellation of registration.

* There are different regulations governing courses that are carried out by the Club School of the Migros Cooperative Geneva. These are to be found at the end of these General Terms and Conditions.
 

Course administration

For organisational reasons, we reserve the right to postpone, combine or relocate classes, or to change the teaching venue. We also reserve the right to shorten a course, in which case the corresponding proportion of the course fee will be reimbursed. Management may replace a teacher for part of a course or for the whole course if necessary.
 

Number of participants and conditions for the course to proceed

In order to present our courses under the best possible conditions, we limit each course to a maximum and minimum number of participants. Spaces are filled on a ‘first come first served’ basis (on condition of payment by the due date). If the number of registered participants falls short of the minimum, the course is usually cancelled and the course fee waived or refunded.

When the number of registrations is below the minimum,, the course may still be offered at the discretion of the School on condition that participants pay a proportionately higher fee or, when appropriate, receive fewer lessons for the same price.
 

Exclusion from a course

School management reserves the right to exclude any participant from a course for a justified reason. If you are excluded from a course, you are liable for the entire course fee – i.e. you would be entitled to neither a full nor a partial refund – in the event of non-payment of the course fee or in serious cases (e.g. libel, harassment, wilful damage to property etc.).
 

Cancellations*

All registrations are binding. Depending on the timing of the cancellation, the course fee may be fully or partially refunded. Such a refund depends on the following conditions: :

For courses up to CHF 1,000.00:

For courses cancelled one week or more before the start date, the course fee is waived or reimbursed, less an administrative charge of CHF 30.00. For cancellations that are received less than one week before the start date, the full course fee is due.

For courses over CHF 1,000.00:

Written cancellation is required. The date of the postmark on your letter of cancellation serves as the date of cancellation. Waiving or refunding of the course fee is calculated as follows:

Date of cancellation: Cancellation charge: 
45+ calendar days before the start date: CHF 100.- administrative charge
44 - 22 calendar days before the start date: 10% of the course fee, (max. CHF 500.-)
21 - 15 calendar days before the start date: 30 % of the course fee
14 - 8 calendar days before the start date: 50 % of the course fee
7 - 1 calendar day(s) before the start date: 80 % of the course fee
On or after the start date: 100% of the course fee

If you have taken out cancellation insurance, you are insured in justified cases (see the general insurance terms) against late cancellation. In the absence of cancellation insurance, the aforementioned terms shall apply.

Migros Club School reserves the right to invoice course participants for third-party charges for overnight accommodation, food, travel etc. when applicable.

Unattendedlessons

Unattended lessons cannot be repeated or refunded.
 

Course attestation

Upon request and subject to attending at least 80% of the lectures, you can be issued with a written attestation of course attendance, or the details of the course can be entered in your "skills passport" (Bildungspass) issued by the Swiss Federation for Adult Learning (SVEB/FSEA). In both cases, however, attestation must be requested within a year of completing the course. Differing regulations with regard to certificate and diploma programs are expressly reserved.
 

Liability and insurance

Migros Club School accepts no liability for any damages arising during or from any courses or events organised by the School. You are therefore personally responsible for ensuring your own adequate insurance cover. Use of Migros Club School facilities is at your own risk. Migros Club School cannot be held liable for theft or loss of property.
 

Data protection

In accordance with Swiss data protection rules, Migros Club Schools shall exercise the utmost care in processing data that you provide to us or that we receive from you for the purposes of registration, delivering the course or for other reasons (e.g. events), or any data that we previously received from you.

On registration, you agree that the aforementioned data may be transferred to other members of the Migros Group (as indicated in the current annual report) and that this data may be combined with additional data held by other members of the Migros Group, or obtained from third parties, and used throughout the Migros Group for the purposes of analysing your contacts and any contracts concluded by you (customer profiles) as well as issuing personalised promotions.

Data shall only be transmitted outside the Migros Group to external service providers, within Switzerland or abroad, in accordance with strict data protection requirements laid down by contract, to law enforcement agencies as prescribed by law, or if the transmission of data is required in order to safeguard and enforce the legitimate interests of Migros.
 

Video and audio recordings

No video or audio recordings may be made in any Migros Club School premises without the express consent of the Migros Club School and course participants.
 

Changes in programme and/or price

Management reserves the right to alter course programmes and/or prices as well as the General Terms and Conditions at any time.
 

Place of jurisdiction

All legal cases concerning Migros Club Schools are subject to Swiss law. The place of jurisdiction is the headquarters of each regional Cooperative.

Special payment terms for the Club School of the Migros Cooperative Geneva

In addition to the national terms applicable in the Club Schools, the special payment terms for the Club School of the Migros Cooperative Geneva are as follows:

Each enrolment requires in principle the full payment of the course fee.

The following terms may however be accepted:

  • for all courses costing less than CHF 100.-, the initial payment is due in full on enrolment, and it is not refundable.
  • for all courses costing CHF 100.- to CHF 750.-, the school requires the payment on enrolment of a non-refundable advance of at least CHF 100.-. The outstanding balance must be paid before the beginning of the course.
  • for all courses costing more than CHF 750.-, the school requires the payment on enrolment of a non-refundable advance of at least CHF 100.-. In case of payment in instalments, the payment of the first instalment is due before the beginning of classes and the last a month before the end of the course.

In all cases, if the client wishes to cancel his or her enrolment before the beginning of the course, the general conditions of the Club School of the Migros Cooperative Geneva shall be applicable, i.e.:

  • Up to 22 calendar days before the beginning of the course, the full amount of the tuition paid is refunded, less CHF 100.- administrative charge. (Courses costing less than CHF 100.- are not refunded).
  • Between 22 and 15 calendar days before the beginning of the course, the total withheld is 30% of the course fee but at least CHF 100.-.
  • Between 14 and 8 calendar days before the beginning of the course, the total withheld is 50% of the course fee but at least CHF 100.- .
  • Between 7 and 1 calendar days before the beginning of the course, the total withheld is 80% of the course fee but at least CHF 100.-.
  • On or after the beginning of the course, the whole course fee is charged.

 

 

General Terms & Conditions for Migros Club School subscriptions

  
(As at January 2018)

These General Terms & Conditions apply at the Migros Club School for customers who have a flat-rate or value subscription.
Valid from January 2018.

Flat-rate subscriptions are valid for a specific time period (e.g. a month, half a year, etc.).

Value subscriptions are valid up to a specific monetary amount or number of entries and in each case over a specific time period (e.g. CHF 200 for 4 months or 10 entries for 4 months).

Applicability
Both flat-rate and value subscriptions are personal and cannot be transferred to third parties.
Subscription owners can book and attend defined courses in the open course system at the centers of the relevant cooperative region defined by the Migros Club School. In other words, customers can register themselves for a course online via the customer portal within the framework of their subscription.

Validity period
Flat-rate and value subscriptions are valid for the time periods predefined by the regional cooperative. When the time period expires, any remaining credit is lost and cannot be reimbursed.

Mutation of the validity period (time stop)
If a subscription cannot be used for a period of at least 28 days due to illness, an accident or pregnancy, a temporary break of up to 9 months may be granted upon written request. A processing fee may be charged. The subscription is extended by the credited time period and in line with the current offer within the framework of the relevant subscription.

Purchase and payment of subscriptions
Verbal or written purchase agreements constitute an obligation on your part to pay for a subscription. Payment deadlines shown on invoices are binding. Failure to pay for a subscription shall not constitute withdrawal from the agreement.

Course organization

Course director
The Migros Club School reserves the right to change the course director at short notice. This shall not entitle participants to reimbursement of their subscription price or even to withdraw from the agreement.

Course running
The Migros Club School reserves the right to change the program of subscription courses at any time. This shall not entitle participants to reimbursement of their subscription price or even to withdraw from the agreement.

Course expulsion
School management reserves the right to exclude one or more participants from a course for a justified reason. The subscription fee shall be due in full (i.e. it will not qualify for proportional reimbursement) in the following cases: Slander, harassment, deliberate damage to property. This list is non-exhaustive.

Course registration and cancellation

Registration
Participants may register for courses via the customer portal up to two weeks and no later than 30 minutes before the start of a course.

Cancellation
Participants may cancel their attendance up to 120 minutes before the start of a course.

Non-attendance
Participants who fail to attend a course on several occasions without prior notification will have the course fees charged to their value subscription in full or will not be reimbursed. In the case of flat-fee subscriptions, the Club School reserves the right to take appropriate sanctions.

Insurance
Migros Club School accepts no liability for any damages arising during or from any courses or events organized by the School. You are therefore personally responsible for having sufficient insurance coverage. Use of Migros Club School facilities is at your own risk. Migros Club School cannot be held liable for theft or loss of property.

Data protection
In accordance with Swiss data protection legislation, Migros Club School exercises the utmost care in processing data that you provide to us, that we receive from you for the purposes of registration, delivering the course or for other reasons (e.g. events) or that we received previously.

By registering, you grant your consent that the aforementioned data may be transferred to other members of the Migros Group, collated with supplementary data available from other members of the Migros Group and used within the entire Migros Group to analyze your contacts and any contracts concluded (customer profiles) as well as for personalized advertising. The Migros Group comprises: the FMC, the Migros cooperatives, Migros stores and specialist markets , retailers belonging to Migros as well as Migros service and production companies.

Data shall only be transmitted outside the Migros Group to external service providers within Switzerland or abroad who are contractually bound to strict data protection requirements, to law enforcement agencies as prescribed by law, or if the transmission of data is required in order to safeguard and enforce the legitimate interests of Migros.

Video and audio recordings

Jurisdiction
